2. The Director of the Regional Civil Aviation Bureau or the Director of the Air Traffic Control Centre may delegate those items which have been delegated to his authority under the provisions of the preceding paragraph, in accordance with the provisions in Ordinances of the Ministry of Transport, to the Chief of the Airport Office under the Regional Civil Aviation Bureau or the Chief of any other regional organisation.
3. Each item prescribed in the following subparagraphs which are under the authority of the Minister of Transport under the provisions of this Law are to be delegated to the Director-General of the Defence Agency in accordance with the provision of a Cabinet Order.
(1)Items as specified under the proviso of Article 94, proviso of Article 94-(2) paragraph 1 proviso of Article 95, Article 96 paragraph 1 and paragraph 3 and Article 97 paragraph 1 and as related to the air traffic control zone of an aerodrome specified under a Cabinet Order and the approach control area connecting thereto specified under a Cabinet Order;
(2)Items as specified under the provisions of Article 96 paragraph 2 and as related to aerodromes as specified under Cabinet Order;
(3)Items as specified under the provisions of Article 97 paragraph 2 and as related to aircraft departing from an aerodrome as specified under Cabinet Order;
(4)Items as specified under the provisions of Article 98 and as related to aircraft which have arrived at an aerodrome as specified under Cabinet Order;
4. The Minister of Transport shall control the items relating to the operations of the service which shall be performed by the Director-General of the Defence Agency in accordance with the delegation under the provisions of the preceding paragraph.
(Interim Measures)
Article 137-(2). In the case of establishment, alteration or revocation of Ordinances of the Ministry of Transport, any necessary interim measures (including interim measures in relation to penal regulations) shall be established, to the required extent, under Ordinances of the Ministry of Transport in accordance with establishment, alteration or revocation there of.
Article 137-(3). (Exceptional application to Administrative Procedure Law) The provisions of the Administrative Procedure Law chapter 2 and 3 (law No. 88 1994) shall not apply to the disposition with regard to the registration of aircraft or the disposition under the provisions of Article 96 paragraph 1 or 2.
2. The provisions of Administrative Procedure Law chapter 2 shall not apply to the disposition with respect to the provision under the provisos of Article 94, Article 94-2 paragraph 1, Article 95, or Article 97 paragraph 1.
